On this “Right to Self-Determination Day”, the Government and people of Pakistan stand in unwavering solidarity with the people of Indian Illegally Occupied Jammu and Kashmir (llOJK). We express our solemn commitment to their just struggle to achieve the inalienable right to selldetermination.
This day commemorates the landmark adoption of the United Nations Commission for India and Pakistan (LTNCIP) resolution on 5 January 1949, a pivotal document that formally guaranteed a free and impartial plebiscite for the people of Jammu & Kashmir.
This commitment is enshrined through multiple United Nations Security Council resolutions on the Jammu and Kashmir dispute, and is reaffirmed annually by the United Nations General Assembly in its resolutions upholding the right to self-determination. Despite enduring decades of oppression and countless sacrifices in IIOJK, the Kashmiri people have remained resolute in their just struggle to achieve the right to self-determination. We salute their unwavering resilience, courage and perseverance.
On this occasion, Pakistan reafflrrms extending its moral, political, and diplomatic support to the people of IIOJK until the realization of their inalienable right to self-determination as enshrined in the relevant United Nations Security Council resolutions.
Rieht to Self-Determination Dav (5 January 2026) Messase from the Deputy Prime Minister/Foreign Minister of Pakistan The intemational law recognizes the right to self-determination as a comerstone principle enshrined the UN Charter. However, the people of IIOJK have been denied this right by India for over seven decades. The illegal occupation of Jammu and Kashmir by India stands as a stark tragedy of our times as the people of IIOJK continue to endure systematic repression, widespread human rights violations and denial of their fundamental rights and dignity.
In particulal tndia’s illegal and unilateral actions of5 August 20l9represent a deliberate attempt to consolidate the illegal occupation through demographic engineering of IIOJK. These measures are designed to systematically transform the Kashmiri people into a disenfranchised community in their own homeland, in clear violation of international law and the principles of self-determination.
Pakistan also calls upon the intemational community, particularly the United Nations, to honour its long-standing commitment with the Kashmiri people and play its mandated role in ensuring a just and peaceful resolution of the Jammu & Kashmir dispute.
حق خود ارادیت کاؤن (5 جنوری 2026) نائب وزیرِ اعظم / وزیرِ خارجہ پاکستان کا پیغام یومِ حقِ خود ارادیت کے موقع پر
حقِ خود ارادیت کے اس دن کے موقع پر حکومتِ پاکستان اور پاکستانی عوام، بھارتی غیر قانونی زیرِ قبضہ جموں و کشمیر (IIOJK) کے عوام کے ساتھ مکمل اور غیر متزلزل یکجہتی کا اظہار کرتے ہیں۔ ہم کشمیری عوام کی اس منصفانہ جدوجہد کے ساتھ اپنی پختہ وابستگی کا اعادہ کرتے ہیں جس کا مقصد ان کے ناقابلِ تنسیخ حقِ خود ارادیت کا حصول ہے۔
یہ دن 5 جنوری 1949 کو اقوامِ متحدہ کے کمیشن برائے بھارت و پاکستان (UNCIP) کی تاریخی قرارداد کی منظوری کی یاد دلاتا ہے، جس کے ذریعے جموں و کشمیر کے عوام کے لیے آزاد اور غیر جانبدار استصوابِ رائے (Plebiscite) کی باضابطہ ضمانت دی گئی تھی۔
یہ عہد جموں و کشمیر کے تنازع سے متعلق اقوامِ متحدہ کی سلامتی کونسل کی متعدد قراردادوں کے ذریعے باقاعدہ طور پر تسلیم اور محفوظ کیا گیا ہے، جبکہ اقوامِ متحدہ کی جنرل اسمبلی بھی ہر سال اپنی قراردادوں کے ذریعے حقِ خود ارادیت کی توثیق کرتی ہے۔
بین الاقوامی قانون کے تحت حقِ خود ارادیت ایک بنیادی اصول ہے جو اقوامِ متحدہ کے چارٹر میں درج ہے۔ تاہم، سات دہائیوں سے زائد عرصے سے بھارت نے مقبوضہ جموں و کشمیر کے عوام کو اس حق سے محروم رکھا ہوا ہے۔
بھارت کا جموں و کشمیر پر غیر قانونی قبضہ ہمارے عہد کا ایک المناک باب ہے، جہاں کشمیری عوام کو مسلسل ظالمانہ جبر، وسیع پیمانے پر انسانی حقوق کی سنگین خلاف ورزیوں اور اپنے بنیادی حقوق اور انسانی وقار سے محرومی کا سامنا ہے۔
پانچ اگست 2019 کے بھارت کے غیر قانونی اور یکطرفہ اقدامات، بھارتی غیر قانونی زیرِ قبضہ جموں و کشمیر میں آبادیاتی تبدیلی کے ذریعے اس غیر قانونی قبضے کو مضبوط کرنے کی دانستہ کوششوں کی عکاسی کرتے ہیں۔ یہ اقدامات کشمیری عوام کو ان ہی کے وطن میں بے اختیار اور محروم بنانے کے مترادف ہیں، جو بین الاقوامی قانون اور حقِ خود ارادیت کے اصولوں کی صریح خلاف ورزی ہے۔
بھارتی غیر قانونی زیرِ قبضہ جموں و کشمیر (IIOJK) میں دباؤ، ظلم، شدید جبر اور ریاستی دہشت گردی کے باوجود کشمیری عوام اپنے حقِ خود ارادیت کے حصول کی منصفانہ جدوجہد میں ثابت قدم رہے ہیں۔ ہم ان کی غیر متزلزل استقامت، جرات اور حوصلے کو سلام پیش کرتے ہیں۔
اس موقع پر پاکستان، اقوامِ متحدہ کی سلامتی کونسل کی متعلقہ قراردادوں کے مطابق، کشمیری عوام کے ناقابلِ تنسیخ حقِ خود ارادیت کے حصول میں اپنی اخلاقی، سیاسی اور سفارتی حمایت جاری رکھنے کے عزم کی تجدید کرتا ہے۔
پاکستان بین الاقوامی برادری، بالخصوص اقوامِ متحدہ، سے مطالبہ کرتا ہے کہ وہ کشمیری عوام کے ساتھ اپنے دیرینہ وعدوں کی پاسداری کرے اور جموں و کشمیر کے تنازع کے منصفانہ، پُرامن اور دیرپا حل کو یقینی بنانے کے لیے اپنے تفویض کردہ کردار کو مؤثر طور پر ادا کرے۔
